Questions about VAT filing deadlines
What happens when a VAT deadline falls on a weekend or public holiday?
It depends on the country. In many jurisdictions — for example Germany (§108(3) AO), Austria (§108(3) BAO), Poland, Spain and Sweden — the deadline moves to the next working day. Others do not extend it: the UK (HMRC), the Netherlands, Ireland, Belgium and the EU OSS and IOSS returns keep the fixed date, so payment has to clear by the last working day before. The calendar above applies the rule for each country and shows which one is in force.
Is the VAT payment deadline always the same as the return deadline?
Usually, but not always. In most jurisdictions the payment must reach the tax authority by the return deadline. In Spain, paying by direct debit (domiciliación bancaria) means filing 5 days earlier, and that earlier date is not extended. Portugal sets separate return and payment dates. Each country’s notes in the calendar list these differences.
How does the EU OSS deadline interact with domestic VAT returns?
The OSS return is quarterly and due by the last day of the month after the quarter (30 April, 31 July, 31 October, 31 January), with no extension for weekends or holidays. It covers B2C distance sales and certain services to other EU countries. If you hold stock in another member state, for example in a fulfilment warehouse, you still file domestic returns there in addition to OSS.
How severe are penalties for missing a European VAT deadline?
They vary widely. Germany can charge a late-filing surcharge of 0.25% per month (minimum €25, up to €25,000) plus 1% per month on unpaid tax. France applies a 10% surcharge. In Poland, uncorrected JPK errors can cost PLN 500 each. Repeatedly failing to file OSS returns can lead to exclusion from the scheme for two years. Each country’s penalties are listed in the calendar.
